On the one hand, the right to roam is hugely significant for those exploring Scotland’s Highlands and Islands, including visitors undertaking the iconic North Coast 500 route. On the other hand, reports of irresponsible visitors and antisocial behaviour have attracted headlines and prompted some to question the breadth of public access rights in Scotland.

However, the right is not unlimited. Its statutory exclusions, limits on responsible exercise and restrictions on geographical scope all help to reduce its impact on privacy, land management and commercial activities. Importantly, irresponsible or antisocial behaviour falls outside the protection of the 2003 Act.

Although Scotland’s access regime is more extensive than that in England, it is not intended to give priority to public access at all costs. Rather, it seeks to strike a careful balance between enabling responsible enjoyment of Scotland’s landscapes and protecting the legitimate interests of landowners and occupiers. The Scottish Outdoor Access Code supports that balance by setting out practical responsibilities for both access takers and land managers, with the aim that, in practice, the right to roam should not be unduly burdensome on landowners.

  1. There are constant attempts to whittle away the right to roam. Some years ago a judge ruled that Anne Gloag had a right to more privacy than the rest of us because she was wealthy and entitled to ban walkers from a wide area around her house i.e. not just curtilage.

    Loch Lomond National Park has passed a by-law banning overnight camping and Cairngorms National Park has banned BBQs. A better approach would be to educate people on how to camp and BBQ safely. That’s what Scandinavian countres do. They teach children from Primary age and build BBQ pits in safe areas.

      Of course the land is not for the (benefit of the ) “many” to enjoy.

      As instead it apparently only exists for the benefit and enjoyment of the wealthy “few” , whose wealth entitles them alone to enjoy the peace and tranquillity and the various pursuits from owning much of the land, that is the land that they , as the wealthy “few” were able to afford to buy because of their vast wealth.

      The UK State is now becoming a place where the “many” will eventually have absolutely nothing.

      That is because the wealthy “few” will soon horde , as in own, everything of value , just to try to deprive the “many” from the benefits that they, the “few“, will always have because of their wealth.

      This will all be done with the blessing of most UK governments, as they, as UK politicians, are beholden to the donations made by these wealthy “few“, that as donations aids their various political elections campaigns.

      Money talks while mostly no one in authority (within UK politics) ever truly wants to listen to the poor , as in those who are part of the “Many“.

      UK State is a cesspit.
