Hospital discharges into care homes – Scottish Government guidance was stricter and thus it ‘is not exposed to legal liability’

The Scottish Guidance

It is of note, as the Court recognised, that the Scottish equivalent guidance of 26th March stated that

…[i]f a patient being discharged from hospital is known to have had contact with other COVID- 19 cases and is not displaying symptoms, secondary care staff must inform the receiving facility of the exposure. The receiving facility should ensure the exposed individual is isolated for 14 days following exposure to minimise the risk of a subsequent outbreak within the receiving facility.

This is very close to the Court’s suggestion of what the ‘rational’ and thus ‘lawful’ course would have been for England’s health authorities. As such it suggests that the Scottish government does not share the DHSC’s potential exposure to legal liability for Covid deaths in care homes – at least in the early stages of the pandemic.

  1. Care Home owners and their political supporters ( ie. unionist politicians ) are desperate to pin the fault for THEIR neglect on to the SG . Otherwise they will be bankrupted by the tsunami of claims from families .

  2. It is clear from the Cumming evidence and events so far that the U.K. government in particular, and the unionist parties in general, politicised the Scottish government response to the pandemic. You can see this from the Xitter timeline of the Tory who described NS as a drooling hag and that of all the leading party members. In this they were aided and abetted by the loyalist press. That apart, I wanted to give you some personal experience.
    My mother in law was resident in a care home. Even before the Scottish government were passed powers to create the necessary lockdowns and take any further action, the care team in the unit were already implementing basic barrier nursing for folk in the home showing symptoms. The experience and training that had helped reduce the impact of Hospital Acquired Infection (c.difficile, winter vomiting bug etc) allowed them to implement a strategy that had worked in the past. We were told that the local community health resources were active within the homes helping drive the plans t protect vulnerable residents. What caught them off guard was the infectivity of this particular virus and the fact that due to the cowboy nature of the Johnson government herd immunity ideology, the virus was already ‘in the wild’. Unfortunately my MIL died following infection with Covid in the April. It would appear that the infection was introduced to the unit by a member of staff.
