I too have noticed this contention about Legal Aid being made here btl multiple times and over a prolonged period. I can’t recall any links to source documents ever being supplied.

I’ve never quite had enough motivation to research the claim tho’ it has occurred to me to do so too in the past. I’m glad you’ve now done this: it’s an important matter. Yet another example of the value of TuS! I hope the persistent ‘campaigner’/btl contributor offers a response to what you’ve found – to agree and withdraw the claim or dispute, and with documentary evidence.

Nowadays, I am much more aware of the value and relative ease of using AI tools to examine such matters, at least to obtain an initial or provisional assessment of a potentially complex matter. Taking c. 10 minutes, I engaged ChatGPT with this query: ‘I’d like assistance in verifying or otherwise the following contention seen online: “Abused women do not get legal aid In Scotland. In England they now get legal aid. Without selling their house.”

As part of a lengthy response to this, ChatGPT concluded this regarding the quoted claim: ‘The statement is misleading and, as written, false. There is an important difference between the Scottish and English systems, but it is not accurate to say that abused women simply “do not get legal aid” in Scotland while England has introduced legal aid for them without regard to their house.’

Later in the exchange, ChatGPT notes: ‘So which jurisdiction is actually more favourable regarding the house? This is perhaps the surprising conclusion. On the narrow question “Does owning the family home prevent initial qualification?” Scotland is arguably more generous. Scotland says that the value of the applicant’s main home is not taken into account in the ordinary capital assessment. England & Wales normally take home equity into account, subject to the £100,000 disregard and the special domestic-abuse/trapped-capital rules.’

Perhaps inevitably with an analysis of legal rules in one jurisdiction and their comparison with those in another, the full result (as given by ChatGPT) is lengthy – beyond the scope (and I’m sure, the patience) of this btl place!
