In May 2022, the above claims were being made repeatedly by Scottish Labour. Here is a typical example:

Jackie Baillie has demanded Nicola Sturgeon faces up to the “unlawful, unreasonable and irrational” decisions her Government made by discharging patients from hospital to care homes at the height of the pandemic which cost lives.

Scottish Labour leader Anas Sarwar raised the issue at First Minister’s Questions this week following a ruling in England that the discharge of untested patients was unlawful prompting the opportunity for those in Scotland who lost loved ones to launch legal action against the Scottish Government.

The Labour Party, of which Ms Baillie is deputy leader, argues that families shouldn’t have to go through a long and emotionally draining legal process to be afforded an admission from Nicola Sturgeon of her Government’s mistakes.

We’ve posted many times to dispute the above but now, from UK COVID-19 INQUIRY – MODULE 7 Closing statement on behalf of Public Health Scotland in the UK COVID-19 Inquiry relative to the Module 7 hearing, published today, the last word:

While PHS fully acknowledges that every death in a care home death was regrettable, its analysis did not find a statistically significant association between hospital discharge of any type and the occurrence of a care home outbreak, but could not rule out a small effect. What was found was that the risk of an outbreak was more strongly associated with increased care home size. The conclusions of the PHS report are in line with other studies in the UK which found that the great majority of care home cases were found in individuals without a link to hospital discharge, i.e. cases infected from contact within the community, for example from either direct import in residents with access to the community or from their contact with other residents, staff, relatives or other visitors to the care home. The Inquiry has heard evidence a number of times and across different modules (including from Professor Nicholas Phin, formerly of PHS [….] and also from Professor Laura Shallcross […] to the effect that hospital discharges were not the main driver of infection in care homes.

    “Neither Anas or I own a mink coat, and my ermine robe is being kept for me, for when I retire to the Lords…….the GMB gave us a wee dug which we called Feckers (just like Tricky Dicky and his dug). If you continue to cast doubt on me, the wee dug might* come to harm, I might* lose my pie allowance and the sky might* fall down”.
