Ferry delay – one rich and powerful man signed the contract and is thus fully responsible

There’s someone missing from this latest in an endless milking of the ferry saga.

It is terrible. Someone should carry the blame for this but he won’t because, though he signed the contract, advised by his own experts, they have been unable to deliver. They want to blame the Scottish Government and/or its agency Cmal but it won’t wash. The man responsible is one of the two below:

Why?

I’m not about to get into a hissing contest over political views because that is precisely what has been abused in this ongoing saga by attempting to exploit the public’s lack of awareness of how Contract Law works and implying political interference.

Once the contract is let, absolutely NOBODY can interfere between parties to the contract, it is entirely bound by Contract Law – Were any politician or beneficial owner to attempt to influence the contract in any way it would generate a punitive claim via the arbitrators of the Contract which would make eyes water financially.

If I had to stick my neck out on why McColl feels so obviously aggrieved, it would be that he banked on and promised the latter providing lucrative returns for investors and bluntly it didn’t pan out, filing for bankruptcy was his last throw of the dice and that failed also. Had McColl the slightest case it would be before the Contract’s appointed arbiter, it really could not be more simple.

Instead what McColl has attempted to retrospectively construct in the public eye is a case of being “Wronged” by an unseen third party when he COULD NOT be wronged under the mutually onerous strictures of the Contract.

Little wonder the “impartial” HMS James Cook were and are so supportive of “ferry-stories”, no embarrassingly incontinent pigeons required, they only need report what others have said, a la Nick Robinson…

  1. Biding by contract law wouldn’t Jim McCall be liable for failure to provide under the terms of the contract, and that failure would put him in a position of being sued? That being the case bankruptcy would avoid such a scenario.

  2. The ferries will be finished. Innovation always takes longer. Saving on fuel. Two others are being built. 4 more ferries. One ferry has been built a year. The same as before the SNP Gov. More tourists are coming since Covid and better weather. More ferries are being built than before. The monies spent on the ferries went into the local economy,

    The monies wasted on HS2 and Hinkley Point. £Billions. £Billions wasted on Brexit. Covid funding £270Billion over two years. Much wasted on fraud. Decommissioning Nuclear £13Billion+ a year over ten years. £130Billion+. The list is endless.

Anyone with any sense can see that since 2014 Scotland has been under attack by Westminster anything Scottish is derided anything good happening in Scotland they try to undermine, let’s be clear this is England doing this to Scotland aided by politicians in Westminster and their mouthpieces at BBC Scotland and the newspapers.
    I look at these reports on BBC and in the newspapers and to me it reads bla bla bla bla bla bla bla bla
    They cant fool me they can’t fool the Scottish people , they can’t even fool English people but there are many who support Englands control of Scotland even some Scottish people but it’s usually because it benefits them financially in some way and they will readily support these attacks on Scotland for the money.
    We never cease to be amazed at what some people will do for money we just feel sorry for them or reckon there is a screw loose somewhere.

      Unfortunately they can fool the Scottish people, at least some of them. Just try canvassing, and you will soon find out that not everyone agrees with our belief that Scotland should be an Independent Nation, governed by Scots. The continuous brainwashing, gaslighting, propaganda, call it what you like, is believed by a lot of our citizens, and unfortunately it will take a generation or more, before we achieve our aim. I’m sorry to say.

  4. The editor and the writer obviously have not followed the evidence produced at the Rural Economy and Connectivity Committee hearings and report, the Public Accounts Committee and the Auditor General!

  5. Not quite true John – Such contracts usually have a team of Claims specialists employed to find loopholes to exploit on behalf on the Contractor – Frequently the objective is to extend the Contract duration and escalate the cost for “unforeseen” issues.
    That such hefty additional costs were awarded to the Contractor by the independent arbiter does imply things went wrong on the Client side, but if the arbiter agrees the delay was caused by issues beyond the Contractor’s reasonable control, even on the supply side, the Contract must be extended.
